DOMICILIUM CITANDI ET EXECUTANDI<\/a><a href=\"#23-general\">23. GENERAL<\/a><\/aside><article class=\"ngi-legal-copy\">\r\n<h2 id=\"1-duration-and-parties\">1. DURATION AND PARTIES<\/h2>\r\nThis registration contract is between NewBridge Graduate Institute (Pty) Ltd (\u201cNGI\u201d), the person registering to study (\u201cStudent\u201d), and the person or entity responsible for payment (\u201cPrincipal Payer\u201d). If the Student and Principal Payer are the same person, both sets of obligations apply.\r\n\r\nThis contract applies only to the academic year or registration period shown in the registration documents, which may run from January to December or July to June.\r\n<h2 id=\"2-important-notice\">2. IMPORTANT NOTICE<\/h2>\r\nThe Student and Principal Payer must read and understand these terms, including the provisions on registration, payment, cancellation, refunds, academic participation, privacy and financial liability, before signing.\r\n<h2 id=\"3-definitions\">3. DEFINITIONS<\/h2>\r\n(a) Qualification: a registered and accredited higher education qualification offered by NGI and recorded on its certificate of registration.\r\n\r\n(b) Programme: the selected course of study, including a qualification, non-qualification or vendor course, module, subject or other structured learning activity.\r\n\r\n(c) Module or subject: a programme component for which the Student may be registered, assessed, charged or required to repeat.\r\n\r\n(d) Contact learning: learning requiring regular attendance at an NGI campus or approved delivery site, with online, hybrid or remote learning where applicable.\r\n\r\n(e) Distance or online learning: learning undertaken mainly through online or remote arrangements with support through NGI systems or centres.\r\n\r\n(f) Distance Support Centre: an NGI support site for distance students, which may offer non-qualification programmes but is not necessarily an approved delivery site for every qualification.\r\n\r\n(g) Application fee: a non-refundable application-processing fee unless NGI agrees otherwise in writing.\r\n\r\n(h) Third-party payer: any person or entity agreeing to pay all or part of the fees; this does not release the Student or Principal Payer unless NGI agrees in writing.\r\n<h2 id=\"4-campuses-distance-support-centres-and-online-learning\">4. CAMPUSES, DISTANCE SUPPORT CENTRES AND ONLINE LEARNING<\/h2>\r\nNot all programmes are offered at every site. Before registration, the Student must confirm the approved site, mode, support arrangements, programme suitability and accreditation status.\r\n\r\nNGI campuses and support centres include Centurion, Klerksdorp, Witbank, Tygervalley, Salt River, Fourways, Musgrave and Upper Highway (Hatton Estate, Pinetown), subject to the current prospectus and regulatory approvals.\r\n<h2 id=\"5-documents-incorporated-into-this-contract\">5. DOCUMENTS INCORPORATED INTO THIS CONTRACT<\/h2>\r\nWhere applicable, this contract includes the current fee and additional-cost schedules, prospectus, programme information, academic and assessment rules, code of conduct, cancellation and refund procedures, bursary or fee-support terms, third-party payer agreement, privacy notice and programme-specific requirements.\r\n<h2 id=\"6-personal-information-and-privacy\">6. PERSONAL INFORMATION AND PRIVACY<\/h2>\r\nNGI may collect and use the Student\u2019s identity, contact, academic, attendance, assessment, payment, support and communication records to administer applications, registration, teaching, assessment, fees and records, and to meet legal or regulatory duties.\r\n\r\nWhere necessary, NGI may share information with regulators and government bodies, service providers, Principal Payers, third-party payers, debt collectors and attorneys for lawful institutional or contractual purposes. NGI will take reasonable security measures and retain records where required.\r\n\r\nThe Student may request access to or correction of personal information. NGI may make recordings for academic, assessment, verification, safety, security or teaching purposes, and may use appropriate images for promotion unless consent is lawfully refused or withdrawn in writing.\r\n<h2 id=\"7-registration-and-accreditation\">7. REGISTRATION AND ACCREDITATION<\/h2>\r\nNGI is registered with DHET as a private higher education institution under the Higher Education Act, 101 of 1997 (2001\/HE07\/003), and offers accredited qualifications recorded on its certificate of registration as well as non-qualification courses.\r\n\r\nBy signing, the Student confirms the selected programme and its status and agrees to comply with the applicable rules, policies, fees, cancellation terms and academic requirements.\r\n<h2 id=\"8-syllabus-curriculum-and-programme-changes\">8. SYLLABUS, CURRICULUM AND PROGRAMME CHANGES<\/h2>\r\nNGI may reasonably change curricula, syllabi, timetables, assessment dates, delivery arrangements, venues or platforms in line with regulatory requirements and will communicate material changes through an official channel\r\n<h2 id=\"9-transfer-to-another-programme\">9. TRANSFER TO ANOTHER PROGRAMME<\/h2>\r\nA transfer application must be made within seven days after classes begin and is subject to space, admission requirements and scheduling. The Student must pay any resulting costs; costs already incurred are not refundable unless NGI agrees or the law requires otherwise.\r\n<h2 id=\"10-academic-credit-exemption-and-recognition-of-prior-learning\">10. ACADEMIC CREDIT, EXEMPTION AND RECOGNITION OF PRIOR LEARNING<\/h2>\r\nSubject to regulation and formal assessment of timely evidence, NGI may grant exemption, recognition of prior learning or credit based on comparability, relevance, level, volume and currency, and may pass an applicable fee credit.\r\n<h2 id=\"11-admission-and-alternative-admission\">11. ADMISSION AND ALTERNATIVE ADMISSION<\/h2>\r\nA Student may register only for a programme whose admission requirements are met, including through an approved alternative route. An incorrectly admitted Student may be required to deregister or transfer to a suitable programme.\r\n<h2 id=\"12-delivery-attendance-and-communication\">12. DELIVERY, ATTENDANCE AND COMMUNICATION<\/h2>\r\nThe Student must understand the delivery method, timetable and support arrangements and must meet attendance, participation and assessment requirements.\r\n\r\nNGI may communicate through registered email, the learning management system, student portal, SMS, WhatsApp or another official channel. The Student must keep contact details current and check these channels regularly.\r\n\r\nDistance students must have a suitable device, reliable connectivity, required software and adequate digital skills. Technical failure does not excuse missed deadlines unless NGI grants an extension.\r\n<h2 id=\"13-duration-of-study-assessment-and-progression\">13. DURATION OF STUDY, ASSESSMENT AND PROGRESSION<\/h2>\r\nUnless NGI approves otherwise, the maximum study period is normally twice the programme\u2019s minimum duration. NGI may withhold assessment entry, progression, certification or re-registration where academic, disciplinary, administrative or financial requirements are unmet.\r\n\r\nAcademic misconduct, including plagiarism, cheating, impersonation, falsification, unauthorised collaboration or misuse of artificial intelligence, may result in disciplinary action, exclusion or termination.\r\n\r\nA Student seeking disability- or health-related accommodation must apply timeously with the required evidence. NGI will consider the request under applicable law, academic requirements and available capacity.\r\n<h2 id=\"14-fees-deposits-and-payment-liability\">14. FEES, DEPOSITS AND PAYMENT LIABILITY<\/h2>\r\n<h3>14.1 Application and Registration<\/h3>\r\nApplication fees for contact education are non-refundable. Registration is complete only when admission, documentation, acceptance and payment requirements have been met.\r\n<h3>14.2 Contact Learning Fees<\/h3>\r\nContact students pay the annual tuition fee and any required deposit in the fee schedule. The first repeat of a module costs R950 plus additional module costs; a second or later repeat attracts the full module fee.\r\n<h3>14.3 Distance and Online Learning Fees<\/h3>\r\nDistance students pay per module. A repeat at the next offering costs R950; a later repeat attracts the full module fee.\r\n<h3>14.4 Additional Costs and Discounts<\/h3>\r\nThe Student must pay communicated compulsory costs, including practical, material, uniform, equipment, excursion, external-assessment or certification costs. NGI may adjust these to recover cost changes and will communicate them where practicable. Discounts apply only on the advertised terms and payment date.\r\n<h3>14.5 Arrears and Access to Services<\/h3>\r\nUnless NGI approves a written arrangement, a Student with unpaid fees may be refused re-registration, continued study, assessments, campus or system access, support, transcripts, records or certification, and may be excluded from activities or preferential pricing.\r\n<h3>14.6 Bursaries and Fee Support<\/h3>\r\nAny bursary, discount, sponsorship or fee support is subject to its stated conditions, which may include payment compliance, participation, academic progress and conduct.\r\n<h2 id=\"15-disciplinary-action-and-code-of-conduct\">15. DISCIPLINARY ACTION AND CODE OF CONDUCT<\/h2>\r\nThe Student must comply with NGI\u2019s code, academic and disciplinary rules. Suspension, exclusion or termination for misconduct does not reduce fee liability.\r\n<h2 id=\"16-collection-fees-and-unpaid-accounts\">16. COLLECTION FEES AND UNPAID ACCOUNTS<\/h2>\r\nThe Principal Payer and other liable signatories are responsible for lawful collection, tracing and legal costs incurred in recovering overdue amounts.\r\n<h2 id=\"17-cancellation-refund-postponement-and-termination\">17. CANCELLATION, REFUND, POSTPONEMENT AND TERMINATION<\/h2>\r\n<h3>17.1 Cooling-Off Period<\/h3>\r\nThe Student has a seven-day cooling-off period from registration. Application fees remain non-refundable; registration fees are refunded only where these terms or the law require it.\r\n<h3>17.2 Cancellation Before Commencement<\/h3>\r\nFor a completed written cancellation received on or before programme commencement, but outside an applicable cooling-off right, NGI retains the registration fee and deposit unless it agrees otherwise or the law requires a refund.\r\n<h3>17.3 Failure to Meet Entrance Requirements<\/h3>\r\nOn proof that the Student does not meet entrance requirements, NGI will refund fees received less non-refundable application or registration fees and costs already incurred.\r\n<h3>17.4 Cancellation After Commencement<\/h3>\r\nAfter programme commencement or expiry of the cooling-off period, whichever is later, the full annual tuition or applicable module fees remain payable.\r\n<h3>17.5 Process and Refund Administration<\/h3>\r\nCancellation must be submitted in writing with all required documents and takes effect when accepted by an authorised NGI representative. Any refund is subject to verification of the request, documents, account and payer details.\r\n<h3>17.6 Early Exit or Absconding<\/h3>\r\nNo completion document or fee remission is due for an incomplete programme, module or course, except in the event of the Student\u2019s death.\r\n<h3>17.7 Postponement<\/h3>\r\nPostponement requires NGI\u2019s written approval. Approved fees may be carried to the next semester or year, subject to availability, academic rules, current fees and increases.\r\n<h2 id=\"18-indemnity\">18. INDEMNITY<\/h2>\r\nThe Student accepts the inherent risks of programme-related activities, including induction, workshops, training, trips, camps, physical activity and travel, and waives claims against NGI, its owners, employees and representatives for related loss, damage, injury, illness or death, including property loss and negligence, to the extent permitted by law.\r\n<h2 id=\"19-participation-in-activities\">19. PARTICIPATION IN ACTIVITIES<\/h2>\r\nThe Student must participate in required academic, safety and health activities, including fire drills. Other non-academic activities are voluntary unless stated otherwise.\r\n<h2 id=\"20-declaration\">20. DECLARATION<\/h2>\r\nBy signing, the Student and Principal Payer confirm that:\r\n\r\n\u2022 the information and supporting documents supplied are complete and correct and material changes will be reported;\r\n\r\n\u2022 they have read and accept the applicable rules, fees, additional costs, payment, cancellation and refund terms;\r\n\r\n\u2022 NGI may discipline, exclude or terminate a Student for breach without reducing fee liability;\r\n\r\n\u2022 they understand and can meet the financial obligations in the fee schedule and any third-party payer agreement; and\r\n\r\n\u2022 NGI may conduct lawful credit checks for credit arrangements.\r\n<h2 id=\"21-surety-and-third-party-payer-arrangements\">21. SURETY AND THIRD-PARTY PAYER ARRANGEMENTS<\/h2>\r\nUnless NGI agrees otherwise in writing, the signatories bind themselves jointly and severally as co-sureties and co-principal debtors for all fees and charges. Failure by a third-party payer does not release the Student, Principal Payer or other signatories.\r\n<h2 id=\"22-domicilium-citandi-et-executandi\">22. DOMICILIUM CITANDI ET EXECUTANDI<\/h2>\r\nThe parties consent to Magistrates\u2019 Court jurisdiction even if the claim exceeds its ordinary monetary jurisdiction. Each party chooses the physical address in this contract for service and must give written notice of any change\r\n<h2 id=\"23-general\">23. GENERAL<\/h2>\r\nNo concession is a waiver or novation. This contract and its incorporated documents are the entire agreement; amendments, cancellations or variations bind the parties only if recorded and formally accepted in writing.\r\n\r\nIf a provision is invalid, the remainder continues.
